By “Opting In” to or using a “Text Message Service” (as defined below) for receiving or sending data from FARHANG & MEDCOFF, PLLC, you accept these Terms & Conditions. This agreement is between you and FARHANG & MEDCOFF, PLLC.
“Opting In,” “Opt In,” and “Opt-In” refer to sending, receiving, requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or similar/successor protocols or technologies).
By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our Privacy Policy (https://farhangmedcoff.com/privacy-policy/) incorporated herein by reference.
Attorney-client privilege may apply to communications between FARHANG & MEDCOFF and our clients or potential clients.
Text Message Service may not be encrypted and is not completely secure against unauthorized access. There is some risk of disclosure and loss of attorney-client privilege in using this form of communication because there is no guarantee of confidentiality. Although we take commercially reasonable precautions to ensure security of our Text Message Service, there is still a risk that your confidential or privileged information may be disclosed. By opting in, you consent to our use of Text Message Service and represent that you understand the risks inherent in modern communications systems.
If you are a client, your agreement to our use of Text Message Service is subject to the terms and conditions of your Engagement Agreement with us, expressly including terms relating to privacy and confidentiality. If you are a client, nothing in this Agreement changes any part of your Engagement Agreement with us. To the extent that your Engagement Agreement may conflict with this agreement, the Engagement Agreement will control.
By sending to us or agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record to document agreement at any time by replying STOP or otherwise opting out.
We do not charge you for the messages you send and receive via this text message service. Message and data rates may apply depending on your plan with your wireless or other applicable provider.
This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).
We will not share your personal information with unaffiliated or non-agent third parties for advertising or marketing purposes absent your express permission, such as may arise during the course of representation.
If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, or similar language. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.
