Roscoe Mutz possesses a broad litigation background, including in the areas of construction law, commercial and business litigation, real estate disputes, employment law, regulatory compliance and audit advice, litigation and compliance issues involving wage and hour law, discrimination and retaliation claims, restrictive covenants, and the Arizona Medical Marijuana Act. Roscoe is also available to serve as a mediator or arbitrator for employment, construction, and general civil litigation disputes.
Roscoe regularly represents subcontractors, general contractors, and owners in litigation, arbitration, and providing construction law advice. Roscoe also represents both employers and employees before state and federal administrative agencies regarding allegations of discrimination and/or retaliation involving Title VII, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Family Medical Leave Act (FMLA), and other applicable statutes and regulations. Roscoe assists employers with preventative advice regarding employment policies, drafting employee handbooks, internal policies and procedures, conducting investigations, drafting employment contracts, and providing employee training on a myriad of employment compliance matters.

Roscoe has represented clients during all stages of litigation and arbitration, from pre-litigation investigation and mediation through trial or arbitration and appeal. In addition to his trial practice experience, Roscoe has also drafted multiple appellate briefs regarding employment discrimination and constitutional issues, including Amicus Curie briefs and appeals to the Ninth Circuit Court of Appeals and the Supreme Judicial Court of Massachusetts.
