Roscoe Mutz possesses a broad litigation background, including the areas of commercial litigation, employment law, real estate disputes, financial regulatory compliance and audit advice, litigation and compliance issues involving wage and hour law, discrimination and retaliation claims, restrictive covenants, the Arizona Medical Marijuana Act, personal injury, products liability, construction law, and wrongful death.
Roscoe regularly represents employers and employees before state and federal administrative agencies regarding allegations of discrimination and/or retaliation involving Title VII, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Family Medical Leave Act (FMLA), and other applicable statutes and regulations. Roscoe also assists employers with preventative advice regarding employment policies, drafting employee handbooks, internal policies and procedures, conducting investigations, drafting employment contracts, and providing employee training on a myriad of employment compliance matters. Roscoe is licensed in Arizona and Massachusetts (inactive).
Roscoe has represented clients during all stages of litigation, from pre-litigation investigation through trial or arbitration and appeal. In addition to his trial practice experience, Roscoe has also drafted multiple appellate briefs regarding employment discrimination and constitutional issues, including Amicus Curie briefs and appeals to the Ninth Circuit Court of Appeals and the Supreme Judicial Court of Massachusetts
